Plea deal reduces charges against Wilson man




A 19-year-old Wilson man entered into a plea deal with prosecutors Wednesday to drastically reduce the prison time he was facing for numerous criminal charges.

Thomas J. Evelyn Jr. of 4609 St. Georges Drive was sentenced in Wilson Superior Court Wednesday by Judge Alma Hinton to no more than 16 months in prison and escaped having to spend more time behind bars.

Since 2008, Evelyn has been charged with hit and run, failure to stop for property damage, misdemeanor possession of drug paraphernalia, two counts of speeding, one count of license not in possession, one count of felonious possession of a Schedule II controlled substance, one count of felonious possession with intent to sell or deliver cocaine, felonious maintaining a vehicle, dwelling or place for the sale or delivery of a controlled substance, 10 counts of felonious breaking and entering, 10 counts of felonious larceny after breaking and entering, three counts of felonious obtaining property by false pretense, felony possession of stolen goods, two counts of felonious larceny of a firearm, felonious possession of a stolen fire arm and misdemeanor communicating threats.

Evelyn pleaded no contest to one count of felonious breaking and entering a dwelling, one count of felony larceny, one count of possession of stolen goods, one count of felonious obtaining property by false pretense, one count of larceny breaking and entering and one count of felonious possession with intent to sell or deliver cocaine, all which carry a maximum sentence of 30 months each. He also pleaded no contest to one count of felonious possession of a Schedule II controlled substance which carries a maximum sentence of 15 months.

All of the remaining charges were dismissed as part of the plea bargain.

Under the plea, Evelyn received two consecutive active sentences of no less than six months and no more than eight months in the N.C. Department of Corrections and received the same sentence on the other charges as well, but those sentences were suspended. Once he is released from prison, he will have to serve 36 months on probation with six of those months being spent on intensive probation. He will also have to pay restitution to the victims of his crimes in the total amount of $7,164.

In an effort to relay Evelyn's community activity, his attorney, Will Farris, told Hinton that Evelyn had been actively involved in the Junior Golf Association, go-cart racing with his father, had worked with the Middlesex Children's Home and performed hurricane relief in Edenton.

Farris also said that Evelyn had been working to try and turn his life around. However, in open court and as part of the sentencing process, Hinton asked Evelyn when was the last time he had consumed any controlled substances. Evelyn answered that he had smoked marijuana five days ago.

As he was being escorted out of the courtroom and into the custody, Evelyn told his parents he loved them.

But Wednesday's sentence wasn't the last time Evelyn will appear before a Superior Court judge for sentencing.

According to the Administrative Office of the Courts, Evelyn is scheduled to appear in Nash County July 13 for felonious assault with a deadly weapon with intent to kill and misdemeanor injury to personal property.

To shutup, SHUT UP!!!! 1. My parents love me dearly. 2. I'm far from broke. I work for a living, me and my wife always have extra, and we just moved into a new home. 3. I've yet to meet a single person in my life that i'm jealous of, so save your ignorance. While you're at it, Wilson Community College does offer English classes. Work on the spelling and grammar buddy! I've read this article, and familiarized myself a bit more with the case, and found that it's bull. Had it been a "lesser" person, meaning the average Wilsonian that doesn't come from privilege or clout, the outcome would be different. Why you, and some try to act as if certain wrong doings, favoritism, and corrupt acts don't exist in Wilson is beyond me. Are you blind, refuse to see the truth, or on the side of some of the same mess that brings Wilson down? You're right about one thing, only God can judge. Still, he gives us free will and common sense to also decipher when something's not right. This case, not right at all.

I knew this kid would get off with a slap on the butt.Goes to show you money talks in wilson.I'll be surprised if he pulls a day in jail.I'm sure mommy and daddy will find a way around that too.Big boy always gets what he wants.He builds a mountain of charges and gets his own business set up for him.That may be why he keeps breaking the law....

And by the way..the justice system is messed up..they dont stick to the law innocent until proven guilty..they go by the word of others. They got no proof! Stop hating and get to work. Do something productive with your life besides talking crap about people you dont know! People can change and who are any of ya'll to judge him. Only God can..try puttin him in your life and you wont have to waste minutes of your life putting bullcrap up here.

It's kind of laughable when you look at the list of charges and the fact he was doing drugs before his hearing that he gets off this easy. The only thing I can assume is that he sold his buddies down the river for a sweet deal and some idiot prosecutor gave it to him. I think this chimp got off way to easy. He has broken enough crimes and he sure as heck knows the difference between right and wrong, so all this I'm trying to turn my life around is a bunch of crap. Proof by action. The fact you said that you are trying to turn it around is completely contradicted by your actions. You are nothing more than a common thief and a thug that needs to be locked away without remorse, sympathy, or mercy. However, I hope the court is as merciful to the next person (and you can bet there will be a next)that catches you trying to steal from them when they take actions to stop you.

I have heard this argument alot; truth is that it is always oppurtunities to do positive things out there.You have tennis courts,basketball courts,baseball fields,churches etc that are not or are underutilized.In every neighborhood there are men who use to be athletes and would love nothing more than to get a chance at organizing and coaching a team or just to teach kids and help prepare them for school sports and possibly college. But if someone was willing kids would not be interested; but if you tell them to just hang out and get into trouble they will.Kids have too much say in what they want to do and not do. Take that right from them.

Sounds to me like the guy is a junkee. Why is there no talk of an intervention? Are his parents being held accountable for being enablers? If he is as dependent on them, and drugs, as it sounds, 16 months will be a long time. This should open our eyes to a bigger problem. The chances are, he will learn more about his criminal life in prison, than rehab. He'll be gang related with all kind of tats when he gets out. Prison is not the answer! He needs to be in an asylum for drugees, and earn his way back into society.

this is a joke.... this guy was charged with more crimes than you can imagine, not to metion the ones he got away with. wait looks like he got away with them all. do a little research, look and see how much time his co-defendants got. alot more than hime. it is a shame that $$$ can get you out of crimes like these. so he has to pay a little bit of restitution. what about the cost of inconvience and the feeling of being violated to the victims of his crimes. i bet when he was arrested, they felt a little better thinking he would be gone for a while. well now what 16 months, he could do that much time and not even realize he was gone. his clothes will still be in style. its about time someone steps in and starts sentencing people to what they deserve not what they pay for.

The system is corrupt because the majority of these people come from two prominent families in Wilson. Come on...wake up and smell the coffee. Our law enforcement is putting their lives on the line every day for us and this is the outcome. Why should they even bother? These criminals are out before they even get their paperwork done. This is a disgrace and the people of Wilson should be OUTRAGED! These criminals are walking and the "court system" is giving them a free pass.

All citizens of Wilson need to snap out of their apathy, before they too become a victim of crime. We HAVE to vote out everyone who contributes to this mess. That means stop voting for someone purely because of party affiliation or race. This applies to local politicians who have a hand in this such as the District Attorney and all the Judges. At the state level it would include the Governor, your local state representatives and senator (who approve spending for the courts, prisons, probation, etc), State Attorney General, Appeals and Supreme Court Justices. PLEASE: Research what they've done and how they've voted - don't take their word or anyone elses word about it. And finally, please don't be taken in by the hype. We're all suffering here because the elected officials count on us to vote with our hearts, not our brains. We have no one to blame but ourselves, folks, until we send a message at the polls.

WOW! What a waste of taxpayers money! I wonder who is going to pay this restitution? I'm sure he's not, but once again, he will milk his parents and not think anything about it. Wonder how much longer people will think they are loaded when they spend their last penny trying to turn around this worthless crook. I would love to have all the dollars they've spent for bailing him out over and over again. Love is blind and money runs out. The sad thing is that he expects to always be bailed out for the messes he gets into. This young man has no conscious and needs to spend many birthdays off the streets to pay for what he's done to our community and to all the time and money he has taken from our system. Let's just see how reformed he is when he gets out of jail. A year, ha ha ha. I think I'll go break into someone's house. I need a new tv.

Law Enforcement does there job again and then the slap on the wrist is given as if expected by every so called convict in town. If you want to become a thief I'd set up shop here because the back room deals are worth there weight in gold. This man has always laughed at the system and he has won again. As mentioned in other comments his day will come he can't resist it. Every victim of every crime should raise there voice and reasons should be explained by the very people giving these wonderful deals. Until someone speaks out and something is done by a higher authority it will not change. Not here or any where else. Once your victimized your a victim through the whole process.

Smoked marijuana five days ago??? This is another example of criminals thumbing their noses at Wilson County Judges, prosecutors and the people of Wilson and getting away with it. The next time you read about this man, he will be charged with a murder or some other serious crime. Put him away for good. I'll help pay for him and others like him to stay in jail. The Wilson Police and Sheriff's Dept. must be disgusted over this happening every day in Wilson county.

This is unbelievable!!! That many charges and he only receives one year. Where's the justice? Why are the police officers working so hard to try to keep our streets safe only to have these habitual criminals sent back out there. Why does it seem like the system just isn't working. Since the economy is bad maybe I should kill my worst enemies,sale a bunch of drugs,do a drive by shooting,break into someones house.If caught with a plea bargain they wwill dismiss the drug sale, breaking and entering, and I plead guilty to murder.Let's see if someone get's 10 years for killing an innocent child surely I can get 5 or less for murder of an adult; maybe in 5 years the economy will be better and when released I can get a better job.If not maybe I can sale the things I stole while breaking into your house and have money saved from drugs. My question is in 5 years will you have replaced what I have stolen, will the neighborhood I saw drugs in be better,and will the family of the person I murdered be over their loss?
